Terms of Service

These Terms of Service ("Terms") govern your use of hosting and web services provided by MK-Dizajn ("we", "us", or "our"). Our services are available to businesses (including craftspeople and sole traders) and to private individuals (consumers). Where a provision applies to only one of these groups, it says so. By purchasing or using our services, you agree to be bound by these Terms.

1. Service Agreement

By purchasing any of our hosting plans or services, you enter into a binding agreement with MK-Dizajn. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Use our services in compliance with all applicable laws and regulations
• Not use our services for any illegal or unauthorized purpose
• Not violate any laws in your jurisdiction or ours

2. Acceptable Use Policy

You may not use our hosting services for:

• Distributing malware, viruses, or harmful code
• Sending spam or unsolicited bulk email
• Hosting illegal content or engaging in illegal activities
• Cryptocurrency mining or similar resource-intensive activities without authorization
• Activities that compromise the security or stability of our servers
• Hosting content that violates intellectual property rights

Violation of this policy may result in immediate service suspension or termination without refund.

3. Payment Terms & Stripe Security

Payment Processing

All payments for our hosting services are processed securely through Stripe, a PCI DSS Level 1 certified payment processor - the highest level of security certification in the payments industry.

Payment Terms

• Hosting plans are billed annually in advance
• Each payment is a one-off payment for the selected term. We do not charge your card automatically; before a term ends we notify you and you renew by paying again
• Failed or missing renewal payments may result in service suspension after a grace period
• We accept major credit cards and debit cards through Stripe

Security Guarantee

We guarantee that your payment information is processed with the highest security standards. Stripe is trusted by millions of businesses worldwide, including major companies like Amazon, Google, and Shopify. For more information about Stripe's security practices, visit stripe.com/docs/security.

Prices and Tax (PDV)

All prices displayed on our website and at checkout are inclusive of 25% Croatian VAT (PDV – Porez na dodanu vrijednost), unless otherwise stated. The amount you pay is the final price.

Business customers in the European Union who provide a valid VAT identification number may be eligible for reverse charge. In that case, the price charged will be exclusive of VAT, and you are responsible for declaring and paying VAT in your own country in accordance with applicable EU rules.

4. Refund Policy and Right of Withdrawal

We offer a 14-day money-back guarantee for all new hosting purchases, to businesses and consumers alike. For consumers it also covers the statutory

• Within 14 days of purchase you can withdraw without giving a reason and receive a full refund. Tell us by email at help@mk-dizajn.hr; a model withdrawal form is available on request
• Refunds are processed to your original payment method within 5-10 business days, and no later than 14 days after we receive your notice
• After 14 days, no refunds are provided for unused service time, except where required by law
• If you ask us to start custom work or an add-on service during the 14 days, we may charge proportionally for what has been performed until you withdraw
• Accounts terminated for Terms of Service violations are not eligible for refunds

5. Service Level Agreement

We strive to maintain 99.9% uptime for all hosting services. However, we do not guarantee uninterrupted service due to:

• Scheduled maintenance (notified in advance)
• Emergency maintenance or security updates
• Force majeure events beyond our control
• Issues caused by third-party services

6. Data and Backups

While we provide automatic backups as part of our service:

• Backups are provided as a courtesy and are not guaranteed
• You are responsible for maintaining your own backups
• We are not liable for data loss, except where it is caused by our intent or gross negligence
• Backup restoration may incur additional fees depending on complexity

7. Limitation of Liability

To the maximum extent permitted by law:

• For business customers, our total liability is limited to the amount paid for services in the past 12 months
• For business customers, we are not liable for indirect, incidental, or consequential damages
• We do not guarantee that our services will meet your specific requirements
• We are not responsible for content hosted on your account

8. Service Modifications and Termination

We reserve the right to:

• Modify or discontinue services with 30 days notice
• Change pricing with 30 days notice to existing customers; a price change applies from your next renewal, never during a paid term
• Suspend or terminate accounts that violate our Terms
• Update these Terms. We will notify registered customers by email at least 30 days before material changes take effect. If you do not agree, you may cancel before then and receive a refund for the prepaid, unused part of your term. Continuing to use the service after the effective date means you accept the new Terms

You may cancel your service at any time through your account dashboard or by email. Cancellation takes effect at the end of your current paid term and no further charges apply. You may also transfer your service to another person free of charge while it is paid through the end of the current term; contact us to arrange it.

9. Intellectual Property

You retain all rights to content you upload to our servers. However, you grant us a license to:

• Store, cache, and display your content as necessary to provide the service
• Create backups of your content
• Use aggregated, anonymized technical statistics (never your content) to improve the service

10. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. We are committed to protecting your personal information and complying with GDPR and other applicable data protection regulations.

By using Stripe for payment processing, you also agree to Stripe's Terms of Service and Privacy Policy. Stripe's handling of your payment information is governed by their own policies, which can be found at stripe.com/privacy.

11. Data Processing on Behalf of Customers

If a website or service you host with us contains personal data of other people (for example visitors, customers or newsletter subscribers), you are the data controller and we act as your data processor under Article 28 GDPR. This section is the data processing agreement between us and applies automatically when you accept these Terms:

• Subject matter and duration: hosting, backup, email forwarding and related services for as long as you use the service
• Nature and purpose: storing, transmitting, backing up and restoring the data you place on our infrastructure. You decide which categories of data and data subjects are involved
• We process personal data only on your documented instructions (these Terms, your use of the service and your support requests), unless EU or Croatian law requires otherwise
• Everyone at MK-Dizajn with access to the data is bound by confidentiality
• We apply appropriate technical and organizational measures: encryption in transit, access control, isolation of customer accounts, regular backups and security updates
• Sub-processors: you give us general authorization to use the sub-processors listed in our Privacy Policy. We will tell you by email at least 30 days before adding or replacing one, and you may object by cancelling the service
• Where a sub-processor transfers data outside the EU/EEA, we ensure safeguards such as the EU–US Data Privacy Framework or Standard Contractual Clauses
• We help you, as far as reasonably possible, to answer data subject requests and to meet your security and breach-notification duties
• We notify you without undue delay after becoming aware of a personal data breach affecting your data
• When the service ends we delete or return your data within 30 days (backups are overwritten on their normal schedule), unless the law requires us to keep it
• We provide the information needed to show compliance and contribute to reasonable audits on written request

12. Information for Consumers

This section applies only if you are an individual buying for personal purposes, not for a business:

• You have a 14-day right of withdrawal as described in section 4. If you asked us to start the service during these 14 days, you pay only proportionally for what was provided until you withdrew
• The mandatory consumer protection rules of your country of residence, including your statutory rights if a digital service is not as agreed, continue to apply and are not limited by these Terms
• Complaints: write to help@mk-dizajn.hr. We aim to reply within 15 days
• If we cannot resolve your complaint you may also turn to a consumer dispute resolution body in Croatia or in your country of residence

13. "Za obrtnike" Offer (Starter Package)

The offer on the /za-obrtnike page for craftspeople and small businesses is governed by these Terms and by the following:

• The first year of the Starter package is offered at 50% off the regular price. The discounted price is shown on the offer page
• Submitting the form is a request, not a contract. Eligibility is reviewed manually, acceptance is our decision and hosting is not activated automatically
• We do not charge your card automatically. We email you before the first year ends; from the second year the regular Starter price shown on the offer page (VAT included) applies if you renew
• The package includes a free .hr domain registered by us through CARNET, subject to CARNET's eligibility rules, and free migration of your existing website when you move your hosting to us
• You may stop using the service at any time without penalty

14. Governing Law

These Terms are governed by the laws of Croatia. Disputes with business customers will be resolved by the competent courts of Croatia. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and may also bring a claim before the courts of that country.
